These Terms of Use govern your access to and use of plotifys.com and any related services operated by PLOTIFYS (“Plotifys”, “we”, “us”, “our”).
By accessing the platform, creating an account, browsing listings or posting a property, you agree to these terms. If you do not agree, do not use the platform.
We may update these terms. Material changes will be notified on the platform and the “last updated” date above will change. Continued use after a change means you accept the updated terms.
1. Definitions
In these terms:
“Platform” means the plotifys.com website, any Plotifys mobile application, and any related service we operate.
“Plotifys”, “we”, “us” and “our” mean Plotifys, a company registered in Pakistan under registration number [INSERT].
“User”, “you” and “your” mean any person who accesses or uses the Platform, whether or not registered.
“Registered User” means a User who has created an account on the Platform.
“Owner” means a Registered User listing a property they personally own.
“Agent” means a Registered User acting as a property consultant, dealer or broker.
“Agency” means a Registered User operating as a firm with one or more Agents.
“Lister” means an Owner, Agent or Agency who posts a Listing.
“Listing” means any property advertisement posted on the Platform, including all text, images, floor plans, videos, prices and contact details within it.
“Content” means any material submitted to, or displayed on, the Platform.
“Services” means all functionality we make available, whether free or paid.
“Paid Services” means any Service for which a fee is payable, including listing plans, featured placement and advertising packages.
“Enquiry” means a message, call or contact request made by a User in response to a Listing.
2. General Terms
2.1 Eligibility. You must be at least 18 years old and legally capable of entering into a binding contract under Pakistani law. By using the Platform you confirm that you meet these requirements.
2.2 What Plotifys is. Plotifys is an online marketplace and advertising platform. We provide the technology that allows Listers to advertise property and Users to find it.
2.3 What Plotifys is not. We are not a party to any transaction between Users. We are not an estate agent, broker, property dealer, valuer, or financial adviser. We do not own, sell, let, manage or inspect any property listed on the Platform. We do not negotiate on behalf of any party, hold any deposit or purchase money, or receive commission on any sale or tenancy.
2.4 No verification of title. Where we describe a Listing or an Agent as “verified”, that means we have carried out a completeness and identity check as described on the Platform. It is not a verification of ownership, title, possession, approval status, or the accuracy of any price. It is not a warranty, endorsement or recommendation.
2.5 Your due diligence. You are solely responsible for verifying any property before entering into any transaction, including verifying ownership records, approvals, encumbrances, dues and the identity of the other party. Never transfer money on the basis of a Listing alone.
2.6 Account registration. You must provide accurate, current and complete information when registering, and keep it updated. You may hold one account only, unless we agree otherwise in writing.
2.7 Account security. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at plotifyss@gmail.com if you believe your account has been accessed without authorisation.
2.8 Acceptable use. You must not use the Platform to post anything unlawful, fraudulent, defamatory, obscene, discriminatory or misleading; to impersonate any person; to interfere with the operation of the Platform; to introduce malware; to circumvent any access restriction; or to scrape, crawl, harvest or copy Content by automated means.
2.9 Our rights over Content. We may review, edit, refuse, remove or reorder any Listing or Content at our discretion, with or without notice, including where it breaches these terms, is inaccurate, is duplicated, or damages the integrity of the Platform.
2.10 Suspension and termination. We may suspend or terminate your account, with or without notice, where you breach these terms, where we reasonably suspect fraudulent or abusive activity, or where required by law. Suspension for breach does not entitle you to a refund of any Paid Service.
2.11 Availability. We aim to keep the Platform available but do not guarantee uninterrupted access. We may suspend access for maintenance, upgrades or reasons beyond our control.
3. Paid Postings
3.1 Paid plans. We offer paid listing plans and promotional placements. The features, listing quota and duration of each plan are as described on the pricing page at the time of purchase.
3.2 Currency and taxes. All fees are stated and payable in Pakistani Rupees (PKR). Fees are exclusive of applicable taxes unless stated otherwise. Any sales tax, withholding tax or other levy applicable under Pakistani law will be applied and is your responsibility.
3.3 Activation. A Paid Service becomes active once payment is confirmed and, where the Listing requires review, once it has passed review. The stated duration runs from activation.
3.4 No guarantee of outcome. A Paid Service buys placement, duration or visibility as described. It does not guarantee any number of views, enquiries, leads, viewings, offers, or any sale or tenancy. We make no representation about commercial outcomes.
3.5 Placement is not endorsement. Featured, premium, hot or similar labels indicate a paid or editorial placement. They do not indicate that we have verified, recommended or endorsed the property or the Lister.
3.6 Refunds and cancellation. Refund and cancellation terms are set out in our Refund and Cancellation Policy at [INSERT URL], which forms part of these terms.
3.7 Removal for breach. If we remove a Paid Listing because it breaches these terms, no refund or credit is due for the unused period.
3.8 Price changes. We may change our prices. Changes do not affect a Paid Service already purchased and active.
3.9 Renewal. Where a plan renews automatically, this will be stated clearly at the point of purchase and you may cancel renewal from your account at any time before the renewal date.
4. Posting Agents
4.1 Authority to list. You may only post a Listing for a property you own, or which you are authorised in writing by the owner to market. We may require evidence of that authority at any time.
4.2 Accurate self-representation. Agents and Agencies must accurately state their name, firm, office location and contact details. You must not describe yourself as an owner if you are an agent, or claim an exclusive mandate you do not hold.
4.3 Registrations and licences. You are responsible for holding and maintaining any registration, licence, or tax status required to operate as a property dealer or agent under Pakistani federal or provincial law. We do not verify these on your behalf.
4.4 One profile. Each Agent may maintain one profile. Agencies may add Agents as team members under the Agency profile. Creating multiple profiles to increase listing quota or search presence is a breach of these terms.
4.5 Verification of Agents. Where an Agent profile is marked verified, we have confirmed identity, an office or business address, and a working contact number. It is not a check of professional competence, financial standing, licensing status or transaction history, and it is not a recommendation.
4.6 Responsibility for Listings. You are solely responsible for the accuracy and lawfulness of every Listing you post, including prices, sizes, plot numbers, possession status and any statement about approvals.
4.7 Responsiveness. You must maintain a reachable contact number and respond to Enquiries within a reasonable period. Persistently unreachable Listers may have Listings removed.
4.8 Prohibited practices. The following are breaches of these terms and may result in immediate removal and suspension without refund:
– Posting a property you have no authority to market
– Bait listings, meaning a property advertised at a price or specification that is not genuinely available, in order to generate Enquiries
– Advertising a property that has already been sold or let, in order to harvest leads
– Duplicating the same property across multiple Listings or accounts
– Posting another Lister’s photographs, floor plans or description
– Misstating plot size, plot number, society, approval status or possession
– Quoting prices in any currency other than PKR
– Using stock photography presented as photographs of the actual property
5. No Spam Policy
5.1 We operate a strict no spam policy. The following are prohibited:
– Posting duplicate or near-duplicate Listings for the same property
– Repeatedly deleting and reposting a Listing to appear as new
– Keyword stuffing in Listing titles, descriptions or agent profiles
– Posting Listings in locations or categories they do not belong to
– Sending unsolicited marketing messages to Users whose contact details you obtained through the Platform
– Using contact details obtained through an Enquiry for any purpose other than responding to that Enquiry
– Collecting, harvesting, scraping or storing User contact data from the Platform
– Using bots, scripts or any automated tool to post, message or extract data
– Posting links to competing property portals, or contact details designed to move Users off the Platform before an Enquiry is made
5.2 Enquiry data. Contact details you receive through an Enquiry are provided for the sole purpose of responding to that specific Enquiry. Adding an enquirer to a marketing list, a bulk SMS campaign or a WhatsApp broadcast without their separate consent is a breach of these terms and may also breach applicable data protection and anti-spam law.
5.3 Consequences. Breach of this section may result in Listing removal, account suspension, permanent ban, and forfeiture of any unused Paid Service without refund. We may also report unlawful activity to the relevant authorities.
6. Limitation of Liability
6.1 Platform provided as is. The Platform and all Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all warranties, express or implied.
6.2 No warranty on Listings. Listings are created by Users, not by us. We do not warrant the accuracy, completeness, currency or lawfulness of any Listing, including any statement about ownership, title, plot number, size, price, possession status, approval status, or the absence of encumbrances or dues.
6.3 No warranty on Users. We do not warrant the identity, honesty, solvency, competence or authority of any User, Agent or Agency.
6.4 Transactions between Users. We are not a party to, and accept no responsibility for, any negotiation, agreement, transaction or dispute between Users. Any contract you enter into is between you and the other party alone.
6.5 Third party content and links. We are not responsible for content on any third party website linked from the Platform, or for any tool, calculator estimate, market figure or guide published for general information. Estimates and guides are informational and must not be relied on as professional, legal, tax or valuation advice.
6.6 Excluded loss. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, loss of opportunity, loss of data, or loss arising from a failed, delayed or fraudulent transaction.
6.7 Liability cap. Where liability cannot lawfully be excluded, our total aggregate liability to you arising out of or in connection with the Platform is limited to the total amount you paid us for Paid Services in the 2 months immediately preceding the event giving rise to the claim, or PKR 35k, whichever is lower.
6.8 Nothing excluded that cannot be. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under Pakistani law.
7. Indemnity
You agree to indemnify, defend and hold harmless Plotifys, its directors, officers, employees and agents from and against any claim, demand, loss, liability, cost or expense, including reasonable legal fees, arising out of or in connection with:
(a) any Content or Listing you post, including any claim that it is inaccurate, misleading, defamatory or unlawful;
(b) your breach of these terms or of any applicable law;
(c) any claim that your Content infringes the intellectual property, privacy or other rights of a third party;
(d) any dispute between you and another User, including any transaction dispute, deposit dispute or claim of misrepresentation;
(e) your use of contact details obtained through the Platform in breach of section 5.
This indemnity survives termination of your account.
8. Property
Note: the user requested this heading. It covers intellectual property, which is the standard meaning of a “Property” clause in marketplace terms. Keep the heading as “Property” for consistency with the requested structure, but make the first line define the scope so readers are not confused with real property.
8.1 Scope. This section concerns intellectual property rights. It does not concern real property advertised on the Platform.
8.2 Our intellectual property. The Platform, including its design, layout, source code, databases, compiled listing data, graphics, and the Plotifys name and logo, is owned by us or licensed to us and is protected by Pakistani and international intellectual property law.
8.3 Restrictions. You must not copy, reproduce, republish, scrape, mirror, frame, sell or otherwise exploit any part of the Platform or its compiled data without our prior written consent. Systematic extraction of Listings is expressly prohibited.
8.4 Your Content. You retain ownership of Content you submit. By submitting Content you grant us a worldwide, non-exclusive, royalty free, sub-licensable licence to host, store, reproduce, adapt, publish and display that Content for the purpose of operating, promoting and improving the Platform. This licence continues for as long as the Content remains on the Platform and for a reasonable period afterwards for backup and archival purposes.
8.5 Your warranties. You warrant that you own or hold all necessary rights in the Content you submit, including in all photographs, floor plans, videos and descriptions, and that its publication will not infringe any third party right.
8.6 Copied Content. Posting a description, photograph or floor plan taken from another website, portal or Lister without permission is a breach of these terms and may infringe copyright. Such Content will be removed and the account may be suspended.
8.7 Infringement complaints. If you believe Content on the Platform infringes your rights, contact us at plotifyss@gmail.com with the URL, a description of the material, evidence of your rights, and your contact details. We will review and, where appropriate, remove the Content.
9. Call Recordings and Brokers
9.1 Platform contact numbers. We may provide tracked or masked telephone numbers to connect Users with Listers, in order to measure Enquiry volume, prevent fraud and resolve disputes.
9.2 Call recording. Calls made through numbers provided by the Platform may be recorded and monitored for quality assurance, verification, fraud prevention, training and dispute resolution. By placing or receiving such a call you consent to it being recorded.
9.3 Notification. Where calls are recorded, a notice will be given at the start of the call. If you do not consent, end the call and contact the other party by another means.
9.4 Retention and access. Recordings are retained for the period stated in our Privacy Policy and are accessible only to authorised personnel, or where disclosure is required by law or by a competent authority.
9.5 Status of Agents and brokers. Agents, Agencies, brokers and property dealers listed on the Platform are independent third parties. They are not our employees, partners, franchisees or representatives. We do not supervise their conduct, guarantee their advice, or control their fees.
9.6 Commission. We do not set, receive, hold or share any brokerage commission. Any commission arrangement is a matter between you and the Agent, and should be agreed in writing before you engage them.
9.7 Complaints about an Agent. Report conduct concerns to plotifyss@gmail.com. We may remove profiles and Listings, but we cannot recover funds, enforce an agreement, or arbitrate a dispute between you and an Agent.
10. Ad Services Package
10.1 Scope. In addition to listing plans, we may offer advertising products including banner placements, homepage or category features, project marketing packages, sponsored content and newsletter placements (“Ad Services”).
10.2 Booking. Ad Services are booked by written order or through the Platform, specifying the placement, dimensions, run dates and total fee. A booking is confirmed once we accept it and payment terms are met.
10.3 Creative approval. You are responsible for supplying creative material to the specifications we provide, by the deadline we state. We may reject or require amendment of any creative that is inaccurate, misleading, unlawful, offensive, infringes third party rights, or is inconsistent with the character of the Platform.
10.4 No guaranteed performance. Unless a specific deliverable is stated in writing in the booking, Ad Services do not guarantee any number of impressions, clicks, enquiries, leads or conversions.
10.5 Placement discretion. We may reasonably adjust placement, positioning or rotation for technical or editorial reasons, provided the agreed value of the package is maintained.
10.6 Payment terms. Ad Services are payable in PKR in accordance with the terms in the booking. We may suspend a campaign where payment is overdue.
10.7 Cancellation. Cancellation terms are as stated in the booking. Where none are stated, cancellation within 7 days of the scheduled start date does not entitle you to a refund of the campaign fee.
10.8 Regulatory compliance. You are responsible for ensuring your advertising complies with all applicable Pakistani law, including advertising standards and any requirement to disclose approval or NOC status for a housing scheme or project. You warrant that any project advertised holds the approvals claimed in the creative.
10.9 Removal. We may remove an advertisement immediately, without refund, where we become aware that it is misleading, or that an advertised project lacks an approval claimed in the creative.
11. General
11.1 Entire agreement. These terms, together with our Privacy Policy and Refund and Cancellation Policy, form the entire agreement between you and us regarding the Platform and supersede any prior understanding.
11.2 Severability. If any provision is found unenforceable, that provision will be modified to the minimum extent necessary, or severed, and the remaining provisions will continue in full force.
11.3 No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
11.4 Assignment. You may not assign or transfer your rights under these terms. We may assign our rights, for example in a corporate reorganisation or sale of business.
11.5 No partnership. Nothing in these terms creates any partnership, joint venture, agency or employment relationship between you and us.
11.6 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disaster, war, civil unrest, epidemic, strike, power failure, internet outage, or government action.
11.7 Notices. We may give notice by email to the address on your account or by posting on the Platform. Notices to us should be sent to plotifyss@gmail.com
11.8 Governing law. These terms are governed by the laws of the Islamic Republic of Pakistan.
11.9 Jurisdiction. The courts at Gujranwala, Pakistan have exclusive jurisdiction over any dispute arising out of or in connection with these terms.
11.10 Language. These terms are published in English. Where a translation is provided for convenience, the English version prevails in the event of conflict.
